{"id":14,"date":"2012-09-10T19:11:16","date_gmt":"2012-09-10T19:11:16","guid":{"rendered":"https:\/\/brettjpeterson.com\/blog\/?p=14"},"modified":"2012-09-10T19:11:16","modified_gmt":"2012-09-10T19:11:16","slug":"copyright","status":"publish","type":"post","link":"https:\/\/brettjpeterson.com\/blog\/2012\/09\/10\/copyright\/","title":{"rendered":"Copyright?"},"content":{"rendered":"<p>For our first assignment in Video and Sound, We were asked to read a few\u00a0<a href=\"http:\/\/www.nytimes.com\/2012\/08\/01\/opinion\/allergy-to-originality.html?_r=2\">articles<\/a> and watch a couple <a href=\"https:\/\/www.youtube.com\/watch?v=L1s_PybOuY0\">videos<\/a> on the topic of original creativity and\u00a0copyright.<\/p>\n<p>I really enjoyed the TED talk by Kirby. I had previously seen his series\u00a0&#8220;Everything is a Remix&#8221; and found myself surprised by the many influences music\u00a0artist in particular drew from. In the TED talk he references patents held by\u00a0Apple Computer. I find it very interesting and timely that the court case of\u00a0Apple Vs Samsung over these referenced patents has recently taken place. The Jury found Samsung guilty and placed a value of one <em>Billion<\/em> dollars on the\u00a0infringement. <a href=\"http:\/\/techcrunch.com\/2012\/08\/24\/apple-wins-patent-ruling-as-jury-finds-samsung-infringes\/\">Link<\/a><\/p>\n<p>This isn&#8217;t an easy issue to understand and solve. <a href=\"http:\/\/www.techdirt.com\/articles\/20120830\/02063020214\/samsungapple-jury-foremans-explanation-verdict-shows-he-doesnt-understand-prior-art.shtml\">subsequent media interviews<\/a>\u00a0of the Jury foreman show that they didn&#8217;t fully comprehend the law or the\u00a0implications of sustaining these patents.<\/p>\n<p>I sit somewhere between both extremes in my opinion on copyright law and\u00a0patents. I do feel that they&#8217;ve been abused by corporations and are used to\u00a0stifle innovation and restrict competition. I can also understand the position\u00a0of content creators that look to earn an income from their work. Software patents in particular are very interesting. I think there needs to be serious\u00a0patent reform such as limiting the term of the patent to a much shorter\u00a0timeframe, but I&#8217;m not sure about abolishing patents completely as some have suggested.<\/p>\n<p>As for appropriation of media samples to remix or otherwise combine and create\u00a0new work, I think those uses should be allowed. They won&#8217;t be confusing end consumers because the product is decidedly different, and the user benefits\u00a0from the new creation where they might otherwise not be served by the copyright\u00a0holder.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>For our first assignment in Video and Sound, We were asked to read a few\u00a0articles and watch a couple videos on the topic of original creativity and\u00a0copyright.
